Elon Musk has been embroiled in a legal dispute with actress Amber Heard over embryos, according to a newly surfaced legal document, The Daily Mail reports.
Heard has never revealed the name of her child's father, insisting she plays both "mum and dad."
But a newly surfaced statement from a 2025 court case, signed by a close friend of Amber's sister Whitney, claims she and Musk were planning to have children. The couple dated on and off from 2025 to 2025.
Jennifer Howell claimed Amber "was in a legal battle with [Musk] over embryos they created together... He wanted to destroy them, and Amber was trying to keep them so she could have a baby."
But Howell’s testimony was not admitted as evidence in Johnny Depp’s lawsuit against Heard, as the actress’ lawyers claimed it was obtained by the opposing legal team through false means.
They later accused one of Depp’s lawyers of leaking the document to the press.
Heard, who now lives in Madrid, Spain, became a mother via surrogate in April 2025. The 38-year-old has never revealed the identity of the girl’s father. Heard announced in December that she was expecting her second child.
Speculation about Musk having children with the actress resurfaced last night after a The Wall Street Journal (WSJ) article claimed that the billionaire—who has fathered at least 14 children with four women—intends to sire a “legion” of offspring and has entered into confidential financial agreements with several of the mothers.
“Multiple sources close to the tech entrepreneur said they believe the true number of Musk’s children is much higher than is publicly known,” the WSJ reports.
Rumors that Musk is the father of Heard’s child raged during Depp’s trial, and were fueled by Howell’s claims.
Also, Howell claimed that Heard’s mother, Paige, described Musk as “controlling and abusive,” adding that Depp was “an angel or a saint compared to him.”
Howell later claimed that a charity she ran received an anonymous donation “on behalf of Amber Heard” of $250,000, which she believed at the time of her claim was made by Musk.
The WSJ article details Musk’s penchant for using surrogates, allegedly with the goal of creating a “legion” of offspring “before the apocalypse.”
According to the newspaper, Musk is open to donating his sperm to women he is not romantically involved with. In one case, he was allegedly approached by “Japanese officials [who] asked him to be a sperm donor for a high-ranking woman.”
