The Armenian government, at its Cabinet meeting Thursday, adopted a decision which sets out the new conditions for carrying out abortion in Armenia.
Accordingly, depending on the gestational period, it is established that up to eight weeks of medical termination of pregnancy can also be performed in outpatient conditions, and a written application is required for abortion with social indications.
In addition, the word “minor” is replaced with the words “under 16 years old,” thereby providing for the requirement of written consent of a legal representative only for patients under 16 years old.
The exercise of the right of girls at the age of 16 and over to make their own decisions about abortion is specified, as well as in the absence of a parent or other legal representative of a person under 16 years old, ensuring the involvement of a contact person authorized by the aforesaid person under 16 years old, while taking into account the child’s opinion.
Also, the consent forms provided for specific cases of medical intervention have been declared invalid, and this will avoid unnecessary repetitions.
In the first subparagraph of the medical indications related to the pathological condition of the fetus or child, the “non-developing pregnancy” diagnosis—often used by doctors—has been added, and this diagnosis is equivalent in content to the “dead fetus” diagnosis in the same aforementioned subparagraph, but the failure to note it was being a cause for misunderstanding.
In addition, a provision has been proposed requiring the woman’s application for an abortion to be uploaded to the electronic healthcare system of Armenia.
